ATM Fee Ruling Kills Best Buy's LCD Antitrust Claims: Toshiba

Law360, New York (October 26, 2012, 7:18 PM EDT) -- Toshiba Corp. on Thursday urged a California federal judge to dismiss Best Buy Co. Inc.'s claims over alleged price-fixing in the liquid crystal display market, reiterating its contention that the retailer lacks standing to seek antitrust damages under the Ninth Circuit's recent ATM fee antitrust ruling.

Toshiba has raised a similar argument in its attempt to nix claims from other companies that purchased finished products that incorporated the LCD components. The Japanese-based electronics maker claims Best Buy shouldn't be allowed to seek damages under federal antitrust...
