Class Waiver Bar Covers Job Applicants, NLRB Judge Says

Law360, New York (October 29, 2012, 3:02 PM EDT) -- Customer management company Convergys Corp. violated labor law by forcing job applicants to waive their right to bring class and collective actions, a National Labor Relations Board judge ruled Thursday, noting that he was bound by the NLRB's controversial decision in D.R. Horton.

Administrative Law Judge Arthur Amchan said that Convergys violated the National Labor Relations Act by maintaining and enforcing mandatory job application provisions in which would-be employees give up their ability to pursue class or collective actions in all forums.
