Amsted Wages Suit OK'd Despite 7th Circ. Don, Doff Ruling

Law360, New York (October 31, 2012, 10:00 PM EDT) -- An Illinois federal judge on Wednesday refused to toss a wage and hour class action against Amsted Industries Inc.’s railcar unit, saying a recent Seventh Circuit ruling on donning and doffing didn’t kill the case.

U.S. District Judge Michael J. Reagan rejected Amsted’s argument that the Seventh Circuit’s May decision in Sandifer v. U.S. Steel Corp. meant the company was entitled to full summary judgment on accusations it forced 478 employees to work before and after their paid shifts.
