Wal-Mart Beats False Ad Suit Over Joint Health Supplement

Law360, New York (November 2, 2012, 1:49 PM EDT) -- A California federal judge tossed a proposed class action Thursday alleging Wal-Mart Stores Inc. deceptively marketed a joint health supplement in violation of false advertising, unfair competition and consumer protection laws, saying the plaintiff had insufficient evidence to back up her claims.

U.S. District Judge Larry Alan Burns specifically said plaintiff Kay Eckler misplaced her false advertising and unfair competition claims by citing health studies that did not actually involve Wal-Mart’s Equate Glucosamine MSM Advanced Triple Strength supplement that is the focus of her complaint.
