Chattem Offers Up To $1.5M To End Mouthwash Suit

Law360, New York (November 2, 2012, 5:36 PM EDT) -- Toiletry and dietary supplement maker Chattem Inc. on Thursday agreed to pay up to $1.5 million to settle a putative class action accusing the company of violating the express warranty for its ACT Total Care mouthwash and deceptively advertising that the product could fight plaque.

In settlement documents filed in the Southern District of California, Chattem said it would establish a $1.1 million settlement fund from which class members who bought 18-ounce mouthwash bottles would get $1.50, while those who bought 33-ounce bottles would get $2....
