4th Circ. Lets Louisiana-Pacific Dodge Shoddy Home-Trim Suit

Law360, New York (November 5, 2012, 2:21 PM EST) -- The Fourth Circuit on Friday affirmed the dismissal of a putative class action accusing Louisiana-Pacific Corp. of manufacturing defective exterior trim for houses that prematurely deteriorates, finding the homeowners did not show aggravating circumstances to merit a negligence claim under North Carolina's economic loss rule.

The suit's three named plaintiffs, who purchased from previous owners homes with Louisiana-Pacific's allegedly shoddy TrimBoard product, had argued they should be placed in a different category from other, original homeowners with whom they have been certified in a separate pending...
