Ex-EDS General Counsel One Day Short On Appeal

Law360, New York (November 2, 2007, 12:00 AM EDT) -- A federal appeals court has upheld a ruling that a former general counsel’s motion to vacate an arbitration award over an age discrimination dispute against Electronic Data Systems Corp. was not filed in time.

The U.S. Court of Appeals for the Seventh Circuit determined Friday that former general counsel David M. Webster missed the three-month deadline to challenge the arbitration award by a day because the statute of limitations begins when the arbitration award is placed in the mail – not when it is received....
