NJ Court Limits Stores' Liability For Shopping Center Lots

Law360, New York (November 6, 2012, 7:05 PM EST) -- New Jersey businesses in multitenant shopping centers generally have no duty to customers for the upkeep of parking lot areas that their landlord is contractually responsible for maintaining, a state appellate court ruled Monday in a published opinion.

Affirming the dismissal of a trip-and-fall lawsuit against Marrazzo's Market at Robbinsville, the appellate court found no reason to extend such a duty of care to the business, based on public policy factors raised by the New Jersey Supreme Court in Stewart v. 104 Wallace St. Inc. That...
