Craftsman Buyers Lose Cert. Bid In Sears False Ad Suit

Law360, Los Angeles (November 6, 2012, 6:34 PM EST) -- A California judge on Tuesday denied class certification in a consumer fraud suit against Sears Roebuck & Co., saying a class of all California buyers of its Craftsman-brand tools since 2001 would be "a procedural management nightmare."

The suit alleges Sears misled consumers into believing Craftsman tools were made in America. Los Angeles Superior Court Judge Anthony J. Mohr cited the logistical complexities of the case in finding it was “inappropriate” for class certification.
