7UP Maker Faces False Ad Suit Over Antioxidant Labeling

Law360, New York (November 8, 2012, 3:43 PM EST) -- A disgruntled consumer lodged a putative class action against 7UP manufacturer Dr. Pepper Snapple Group Inc. in California federal court Thursday, claiming the company has misled customers by falsely marketing its soda products as healthy, antioxidant-rich beverages.

The soda maker prominently uses the word “antioxidant” on several products along with pictures of fruit, but the beverages contain no real fruit or fruit extracts and include only a small amount of the single antioxidant Vitamin E, according to the suit.
