Sanofi Dodges Amphastar's FCA Suit Over Lovenox

Law360, New York (November 15, 2012, 5:55 PM EST) -- A federal judge in California on Wednesday dismissed a whistleblower lawsuit filed by Amphastar Pharmaceuticals Inc. alleging competitor Sanofi-Aventis SA illegally conspired to monopolize the market for its patented anti-coagulant drug Lovenox, resulting in state and federal governments paying grossly inflated prices for the medication.

Senior U.S. District Judge Marvin J. Garbis of Maryland, sitting by designation in a Riverside, Calif., court, ruled that Amphastar failed to specifically allege facts that would give rise to a claim under the False Claims Act.
