Merck Generics Division In Settlement Talks Over Anti-Depressant Drug Patent

Law360, New York (August 29, 2005, 12:00 AM EDT) -- New York-based Forest Laboratories Inc. and its Danish licensing partner H. Lundbeck AS are in settlement talks with Australian generic drug maker Alphapharm Pty. Ltd. over its updated antidepressant drug Lexapro, (escitalopram oxalate).

Alphapharm, part of Germany-based Merck’s generics division, was sued by Lundbeck and Forest in May 2004 in U.S. District Court for the Southern District of New York. The case was transferred in September to Delaware.
