Mid-Century Can't Recoup DR Horton Coverage Row Costs

Law360, New York (November 16, 2012, 5:05 PM EST) -- A Colorado federal judge on Tuesday rejected Mid-Century Insurance Co.'s request that he reconsider his dismissal of the insurer's attempt to recover defense costs from D.R. Horton Inc. in a coverage dispute over a $39.5 million home construction defect suit.

U.S. District Judge William J. Martinez said grounds warranting a motion to reconsider include an intervening change in the controlling law, new evidence previously unavailable, and the need to correct clear error or prevent manifest injustice — none of which were met by Mid-Century's motion to...
