IP Law Profs. Back Aereo In 2nd Circ. Streaming Dispute

Law360, New York (November 16, 2012, 5:34 PM EST) -- Intellectual and copyright law professors Thursday urged the Second Circuit to affirm a ruling that streaming service Aereo Inc. does not violate the copyrights of major TV networks, arguing that Congress, not the courts, must determine whether new technologies violate copyright law.

In an amicus brief, 34 professors said the Second Circuit should follow a lengthy Supreme Court tradition that defers to Congress when the Copyright Act is ambiguous or silent about new technologies such as Aereo, which assigns users an individual antenna to watch over-the-air...
