US Owes Assistance In Toxic Exposure Suits, KBR Says

Law360, New York (November 20, 2012, 1:30 PM EST) -- KBR Inc. on Friday sued the U.S. in the Court of Federal Claims after the government declined to help defend the military contractor against suits brought by American and British military personnel who were injured by toxic chemical agents while guarding an oil-related facility in Iraq.

KBR is lodging an appeal of a contracting officer's final decision under the Contract Disputes Act, arguing that the government has breached an indemnification agreement by not participating in or assuming direct responsibility for defending KBR in tort litigations related...
