Gas Royalty Suit Class Wrongly Certified, 10th Circ. Told

Law360, New York (November 20, 2012, 4:58 PM EST) -- The certification of a 16,000-member class accusing an Exxon Mobil Corp. unit of failing to pay proper royalties on natural gas wells in Oklahoma ignores heightened standards created by Wal-Mart Stores Inc. v. Dukes, the Tenth Circuit heard Friday.

The Oklahoma Independent Petroleum Association, the Mid-Continent Oil and Gas Association of Oklahoma, and Linn Energy Holdings LLC each filed amicus briefs supporting XTO Energy Inc.’s appeal of U.S. District Judge Frank H. Seay’s April 12 order granting class certification in the suit.
