NY Appeals Court Tosses Challenge To Domino Project

Law360, New York (November 20, 2012, 5:57 PM EST) -- A New York state appeals court on Tuesday affirmed New York City's approval of a multibillion-dollar residential redevelopment of the former Domino Sugar refinery, despite protests over affordable housing and environmental impact by a Brooklyn community coalition.

The appeals court said that the 30 percent affordable housing figure used by the developer of the project — a massive mixed-use redevelopment plan for the 11-acre site around the former refinery on the Brooklyn waterfront — was adequately disclosed to the public as a goal, not a binding commitment....
