Strippers Win FLSA Class Cert., But Counterclaims Stand

Law360, New York (November 27, 2012, 2:05 PM EST) -- A Maryland federal judge granted early-stage certification Monday to a class of exotic dancers who said they were improperly classified as independent contractors, but also left intact counterclaims that could offset eventual damages if the strippers prevail.

U.S. District Judge Deborah K. Chasanow ruled that Laura McFeeley and Danielle Everett had satisfied the fairly lenient requirements for conditional collective certification under the Fair Labor Standards Act, allowing them to notify other dancers at two Maryland clubs who might have been underpaid because of their contractor statuses....
