Int'l Paper Wants Atty Fee Agreement Axed In Enviro Suit

Law360, Houston (November 27, 2012, 11:07 PM EST) -- International Paper Co. and Waste Management Inc. on Tuesday told a Texas appeals court that a state law authorizing a contingency fee arrangement between Harris County and Connelly Baker Wotring LLP to handle a multibillion environmental enforcement suit was unconstitutional.

Attorneys for International Paper and Waste Management argued to the First Court of Appeals that the county’s use of "profit-motivated, contingency-fee counsel” to pursue a "quasi-criminal” case seeking up to $3 billion in civil penalties violated the companies’ due process rights.
