Citgo Denied $40M Insurance Claim On Enviro Suits

Law360, Houston (December 3, 2012, 10:27 PM EST) -- A Texas state judge on Monday shot down Citgo Petroleum Corp.'s request to find that U.S. Fire Insurance Co. should defend it to the tune of $40 million in multidistrict litigation alleging the company's defective gasoline caused environmental pollution.

In denying Citgo's motion for summary judgment, Judge Kyle Carter said that choice-of-law questions and the possible need to bring another insurance company into the suit required factual development that precluded him from granting the company's request.
