Con Ed Wins $1.7M In Eminent Domain Case

Law360, New York (November 30, 2012, 5:25 PM EST) -- The City of Yonkers Industrial Development Agency must pay Consolidated Edison of New York Inc. $1.7 million for taking a parcel of land in Westchester County for road construction under eminent domain, a New York court ruled Wednesday.

Judge John LaCava of the Supreme Court of Westchester County said the figure was based on an appraisal of the highest and best use of the property, which Con Ed used for electrical operations before the IDA took it for a road-building project.
