JPMorgan Can't Arbitrate Policy That Was Once In Loan Suit

Law360, New York (November 30, 2012, 8:13 PM EST) -- A New Jersey federal judge on Friday blocked JPMorgan Chase NA from trying to force arbitration on a mortgage insurance coverage policy that was at one point part of still-ongoing litigation between the bank and Republic Mortgage Insurance Co. over rescinded insurance coverage.

U.S. Judge William J. Martini said that since the policy in question had been part of a complaint, which has since been dismissed, and relates to a set of issues that are still before the court, it cannot proceed to arbitrate the policy,...
