8th Circ. Revives Fuel Grade Case Against Gas Retailers

Law360, Chicago (December 3, 2012, 6:47 PM EST) -- The Eighth Circuit on Monday revived a putative class action accusing MFA Petroleum Co. and two other gasoline station operators of misrepresenting the grade of their fuel, axing a lower court's finding that the suit's state law claim is preempted by a federal statute.

In a 2-1 published ruling, a three-judge panel reversed the dismissal of a suit that consumer Joyce Johnson brought against MFA, Casey's General Stores Inc. and Quicktrip Corp. under the Missouri Merchandising Practices Act and remanded it to a Missouri federal court....
