Walgreen Demands Toss Of Suit Over Joint Products Labeling

Law360, Chicago (December 5, 2012, 3:28 PM EST) -- Walgreen Co. asked an Illinois federal court on Tuesday to dismiss a putative class action accusing it of falsely marketing its glucosamine chondroitin complex joint health products, saying the plaintiff relies on studies related to a disease the products were never intended to treat.

In a memorandum filed with its bid to dismiss, Walgreen argued the allegations that California resident Luis Guilin made in his fourth amended complaint were conclusory and vague, and that he had "pled himself out of court" by relying on studies testing...
