Coke, Ad Firm Accused Of Spam Texting College Football Fans

Law360, New York (December 6, 2012, 2:10 PM EST) -- A University of Alabama football fan whose text message vote supporting his favorite team allegedly led to unsolicited mobile spam lodged a putative class action against The Coca-Cola Co. and marketing firm Mozes Inc. in Alabama federal court Wednesday.

Coca-Cola used Mozes to send advertisements for its Coke Zero product to thousands of consumers without permission, violating the Telephone Consumer Protection Act and entitling text message recipients to at least $500 in damages, according to the suit.
