Medline Workers Ask 9th Circ. For Class Cert. In Wage Case

Law360, Los Angeles (December 7, 2012, 5:48 PM EST) -- Medline Industries Inc. employees urged the Ninth Circuit on Friday to order certification of their putative wage-and-hour class action against the medical products manufacturer, saying a lower court erred in finding there would be a need to determine individual damages.

The workers' attorney David DeRubertis said the appeals court's long-standing precedent precluded U.S. District Judge Gary Klausner from denying certification on the basis that individual damage determinations would make class treatment of their claims unmanageable.
