Judge Will Hear State Claims In Pom, Coke Labeling War

Law360, New York (December 7, 2012, 10:53 PM EST) -- A California federal judge on Friday reversed an earlier decision to send state law claims in Pom Wonderful LLC's deceptive marketing and unfair competition suit against The Coca-Cola Co. to state court after learning that he would have to rule on the claims regardless in a related class action.

U.S. District Judge S. James Otero agreed to accept jurisdiction over the state law claims after the parties expressed their intents to refile currently stayed motions raising the same issues of law on those state court claims...
