First American Refi Rate Class Decertified Under Dukes

Law360, New York (December 10, 2012, 4:31 PM EST) -- A Maine federal judge on Monday decertified a class of 76,000 homeowners who claimed First American Title Insurance Co. overcharged them when they refinanced their mortgages, citing stricter class certification standards in the wake of Wal-Mart Stores Inc. v. Dukes.

U.S. District Judge George Z. Singal granted First American's motion to decertify the proposed class, which was originally certified more than two years ago, saying that it no longer fits the more stringent commonality standards resulting from the U.S. Supreme Court's 2011 Dukes decision.
