WellPoint Defeats Final Claims In Premium Hike Class Action

Law360, Chicago (December 10, 2012, 6:25 PM EST) -- An Illinois federal judge handed WellPoint Inc. summary judgment Monday on the last remaining claims in a putative class action alleging it bungled coverage for former Rightchoice Managed Care Inc. customers after it bought that company, rejecting the plaintiffs' liability arguments and ending the suit.

U.S. District Judge J. Phil Gilbert ruled against plaintiffs Charlotte Phillips and Bob Myrick on their remaining claims against WellPoint, its Unicare subsidiaries and Rightchoice for breach of contract and unfair trade practices under the Illinois Consumer Fraud Act.
