Cabot Asks 3rd Circ. To Take Up Pa. Fracking Lease Rights

Law360, Philadelphia (December 10, 2012, 5:58 PM EST) -- Cabot Oil & Gas Corp. on Friday asked the Third Circuit to allow it to extend a gas lease after a Pennsylvania landowner unsuccessfully sued to break it, arguing that companies should be entitled to the extra interval of time when suits stall drilling efforts.

Cabot claimed that the property owner, Wayne Harrison, sued the company because he was dissatisfied with the terms of his lease, and that his litigation ate into its “window of opportunity” for drilling.
