Allegheny Wants Ex-Steelworkers' ERISA Action Tossed

Law360, New York (December 10, 2012, 7:08 PM EST) -- A unit of Allegheny Technologies Inc. on Monday asked a Pennsylvania federal court to toss a proposed class action alleging the specialty metals company improperly modified pension agreements for retired steelworkers, saying Allegheny reserved the right to make changes.

Allegheny Ludlum Corp. said little had changed in the plaintiffs' most recent amended complaint and said the lawsuit still failed to show the retirees' benefits were vested and couldn't be changed, and also failed to show the modified agreements violated fiduciary duties under the Employee Retirement Security...
