Toto's Royalties Suit Should Be Trimmed, Judge Says

Law360, New York (December 12, 2012, 7:52 PM EST) -- Rock band Toto's dispute with Sony Music Entertainment over digital download royalties should continue, but a large part of the lawsuit should be dismissed, a magistrate judge told a New York federal court Tuesday.

Advising the court on Sony's motion to dismiss an amended complaint by Toto Inc., U.S. Magistrate Judge Andrew J. Peck said the band still fails to prove its February suit should be considered timely for claims on royalties it says Sony failed to pay from January 2005 to June 2008.
