Class Cert. Denied In Tinkertoy False Advertising Suit

Law360, Los Angeles (December 12, 2012, 5:49 PM EST) -- A California judge Wednesday refused to certify a proposed class of consumers who sued Hasbro Inc. for false advertising, finding not enough buyers were misled into believing models pictured on the packaging of a Tinkertoy set could be built with the pieces included.

Los Angeles Superior Court Judge John Shepard Wiley said the plaintiffs' claim under California's Unfair Competition Law could not be subject to common proof because they had only presented evidence that fewer than 100 consumers had complained to Hasbro about the alleged nondisclosure...
