DC Circ. Tells FCC To Grant VHF Channel Move Between States

Law360, New York (December 17, 2012, 2:20 PM EST) -- The D.C. Circuit on Friday ordered the Federal Communications Commission to allow a television station operator to move very high frequency channels from Nevada and Wyoming to New Jersey and Delaware, respectively, saying the move is “technically feasible" under the Communications Act.

A three-judge panel reversed the commission’s finding that blocked PMCM TV LLC’s request to “reallocate” the VHF channels to states where there were none following the country's 2009 transition from analog to digital television broadcasting, remanding the order with instructions to approve the move....
