Texas High Court Mulls City's Immunity From Land-Option Suit

Law360, Houston (January 9, 2013, 8:08 PM EST) -- Texas’ highest court on Wednesday grappled with whether a developer that sold land to a city for use as a public park can sue for damages after the former owner’s contractual option to repurchase the property was denied.

El Dorado Land Co. LP argued to the Texas Supreme Court that the City of McKinney destroyed the option’s value by refusing to sell the property back to the developer and that it was entitled to be paid for the lost interest.
