Houston Loses Bid To Revive Electricity Overbilling Suit

Law360, Houston (December 20, 2012, 3:40 PM EST) -- A Texas appeals court on Thursday denied the city of Houston’s request to revive its multimillion-dollar overbilling suit against a unit of CenterPoint Energy, ruling that the case should be heard by the Public Utilities Commission, not a court.

The First District Court of Appeals ruled that the state’s Public Utility Regulatory Act required the city to pursue through the PUC its complaint that CenterPoint overcharged it millions for electricity over a span of 20 years.
