'Elder Scrolls' Defect Case Canned By 11th Circ.

Law360, New York (December 20, 2012, 6:07 PM EST) -- The Eleventh Circuit on Thursday upheld the dismissal of a proposed class action accusing the makers of the “Elder Scrolls” video game of deceptively marketing and selling a defective product, finding the plaintiff applied the wrong state's laws and failed to define a qualified class.

Lawrence Walewski's complaint asserted claims against Zenimax Media Inc. and Bethesda Softworks LLC under Maryland law, but a three-judge panel said a district court correctly found Florida law applied in the case, meaning Walewski lacked standing to pursue his Maryland claims....
