Houlihan's Can't Shake Class Action Over Pricey Drinks

Law360, New York (December 21, 2012, 1:42 PM EST) -- Houlihan's Restaurants Inc. lost a bid Thursday to toss a putative class action against the restaurant chain in New Jersey, saying the plaintiff's allegations he was charged an unreasonable amount for drinks from a menu with no prices were enough to support claims for breach of contract or unjust enrichment.

While Houlihan's raised several questions that Judge Jerome B. Simandle said might be pertinent in a motion for summary judgment, the defendant failed to shake plaintiff Ted Pauly's claim with its motion to dismiss his January...
