BMW Tries To Avoid 7 Series Roll-Away Defect Class Action

Law360, New York (December 21, 2012, 5:10 PM EST) -- BMW of North America LLC argued Thursday that a proposed class action in New Jersey over certain car models that unexpectedly shift into neutral or reverse should be dismissed because the plaintiff has not claimed any loss or injury and thus lacks standing to bring the case.

Plaintiff Monica McQueen, who filed suit in October, alleges that her 2004 BMW 745i shifted into reverse at times when she had put it in park and that she may have to spend $4,000 to repair it.
