Bench Trial Set In Macy's, JC Penney, Martha Stewart Fight

Law360, New York (January 3, 2013, 2:24 PM EST) -- A New York state judge ruled Thursday that he, not a jury, will decide at a trial next month if Martha Stewart Living Omnimedia Inc. violated its contract with Macy's Inc. when the TV personality's company defected to rival retailer J.C. Penney Co. Inc.

Judge Jeffrey K. Oing said during a hearing that MSLO's jury demand was based on now-dropped counterclaims for money damages, without which there was no basis for a jury trial. Furthermore, he said any money damages from ancillary issues paled in comparison...
