UnitedHealth Takes Reimbursement Fight To Supreme Court

Law360, New York (January 7, 2013, 9:59 PM EST) -- UnitedHealth Group Inc.’s insurance unit on Thursday asked the U.S. Supreme Court to review a ruling that allows a Texas-based medical device provider to bring state-law claims alleging it improperly refused reimbursements under UnitedHealth-administered employee retirement plans.

The Fifth Circuit, in an en banc October ruling, found the Employee Retirement Income Security Act doesn’t preempt negligent misrepresentation, promissory estoppel and Texas Insurance Code violation claims brought by Access MediQuip LLC in its suit against the insurer.
