Judge Tosses Bed Bath & Beyond Derivative Suit

Law360, New York (November 19, 2007, 12:00 AM EST) -- A federal judge has dismissed a shareholder derivative action against Bed Bath & Beyond and 19 company directors over alleged options backdating six months after a state court dismissed a similar derivative case.

Judge Joel A. Pisano of the U.S. District Court for the District of New Jersey ruled that the plaintiff was barred from bringing claims because of the dismissal of the New York state suit against Union, N.J.-based Bed Bath & Beyond.
