Judge Denies Class Cert. In Toyota Hybrid Braking MDL

Law360, New York (January 9, 2013, 6:29 PM EST) -- A federal judge on Tuesday denied class certification in multidistrict litigation over an alleged defect in Toyota Motor Corp.’s hybrid vehicles’ braking systems, saying a substantial majority of class members never suffered an actual injury that was caused by the defect.

Owners of the Toyota hybrids filed five separate class actions in February 2010, later consolidated into an MDL, alleging Toyota had fraudulently induced them to purchase their hybrids by concealing the alleged defect in the braking system.
