Fla. Court Affirms Class Cert. In Foreclosure Mill Case

Law360, New York (January 10, 2013, 3:47 PM EST) -- A Florida appeals court on Wednesday affirmed class certification in a suit accusing the now-shuttered Law Offices of David J. Stern PA, which once handled more foreclosures than any other firm in Florida, of charging excessive fees to homeowners facing foreclosure.

In the suit, filed in October 2009, lead plaintiff Rory Hewitt says Stern sent homeowners facing foreclosure reinstatement letters seeking excessive or inappropriate costs for title searches or title examinations and other fees and costs that had not yet been incurred. Hewitt is representing a...
