HMA Gets Reprieve In Medicare Billing FCA Suit

Law360, New York (January 15, 2013, 2:09 PM EST) -- A Tennessee federal judge on Monday gave Health Management Associates Inc. a reprieve from a former employee’s False Claims Act suit over alleged Medicare anti-kickback law violations, dismissing the suit but allowing the relator to amend his complaint.

According to U.S. District Judge Thomas A. Wiseman Jr., former HMA doctor Kevin Dennis had failed to provide specific evidence that HMA had defrauded Medicare and Medicaid by allegedly billing them for patients unlawfully referred to its University Medical Center in Lebanon, Tenn., by doctors at the hospital,...
