LG Loses Bid To Claim Double Recovery In LCD MDL

Law360, New York (January 16, 2013, 4:00 PM EST) -- A California federal judge on Tuesday refused to let LG Display Co. Ltd. argue that Rockwell Automation Inc.'s state price-fixing claims would lead to duplicative recovery in the multidistrict litigation over liquid crystal display panels.

U.S. District Judge Susan Illston reiterated her earlier decisions in the MDL holding that duplicative recovery was often a "necessary consequence" from state indirect purchaser damages claims in cases alleging a nationwide price-fixing plot when federal claims from direct buyers are also involved.

LG had brought both counterclaims and affirmative defenses...
