NJ Appeals Panel Grants HoJo Indemnity In 2006 Accident

Law360, New York (January 16, 2013, 5:40 PM EST) -- A New Jersey appeals court ruled Wednesday that G&G Hotels Inc. is contractually bound to indemnify Howard Johnson International Inc. for personal injury claims related to a 2006 accident involving two men who fell out of a third-floor window at an Atlantic City hotel.

A three-judge panel ruled that a 1995 license agreement between independent hotel operator G&G and budget hotel franchise Howard Johnson included a provision stipulating that Howard Johnson would be entitled to indemnification from G&G for claims arising from Howard Johnson’s negligence, according...
