Supreme Court To Weigh Mixed Causes For Bias Claims

Law360, New York (January 18, 2013, 7:47 PM EST) -- The U.S. Supreme Court on Friday agreed to consider whether workers claiming discrimination under employment laws that do not specifically authorize mixed-motive claims must prove that their employer would not have taken action against them but for an improper motive.

The high court granted University of Texas Southwestern Medical Center's petition for certiorari in a case brought against the medical school by former faculty member Dr. Naiel Nassar, who claimed retaliation under Title VII after allegedly being harassed by a supervisor because of his race. ...
