Gupta Attacks Wiretaps, Conviction In 2nd Circ.

Law360, New York (January 22, 2013, 1:43 PM EST) -- Former Goldman Sachs Group Inc. director Rajat Gupta pressed the Second Circuit on Friday to reverse his conviction on insider trading charges, arguing a jury should not have heard wiretaps supposedly implicating him in a scheme to pass tips to hedge fund boss Raj Rajaratnam.

In a 61-page brief, Gupta, the most prominent defendant convicted for insider trading during Manhattan U.S. Attorney Preet Bharara’s five-year crackdown, argued that a New York federal court wrongly allowed prosecutors to play Rajaratnam’s phone conversations with two Galleon employees....
