EBay Says DOJ's Hiring Conspiracy Claims Don't Hold Up

Law360, New York (January 23, 2013, 5:59 PM EST) -- EBay Inc. on Tuesday urged a California federal court to dismiss the federal government's suit accusing it of violating antitrust law by agreeing not to recruit or hire Intuit Inc. employees, arguing the government hadn't alleged an actionable conspiracy or harm to competition.

EBay not only took aim at the federal government's Sherman Act suit, but also sought dismissal of a related antitrust suit brought by the state of California, arguing both complaints failed to state a claim on which relief could be granted.
